1. Overview
This Acceptable Use Policy ("AUP") forms part of the agreement between SIVDA LTD ("Sivda") and you, the Client. It governs the use of all Services provided by Sivda. By accessing or using any Service, you agree to comply with this policy in full. Breach of this AUP constitutes a material breach of your agreement with Sivda and may result in immediate suspension or termination of your services without notice or refund.
2. Prohibited Content
You may not use the Services to host, store, transmit, distribute, or facilitate access to any content that:
- Is unlawful under the laws of England and Wales or any other applicable jurisdiction;
- Constitutes, facilitates, promotes, or normalises adult, pornographic, or sexually explicit material of any nature;
- Constitutes, facilitates, or promotes gambling, wagering, lotteries, or unregulated gaming activities;
- Contains or distributes malware, ransomware, spyware, trojans, rootkits, keyloggers, or any other malicious or harmful code;
- Constitutes phishing, credential harvesting, identity fraud, or social engineering infrastructure of any kind;
- Infringes the intellectual property rights, privacy rights, or other rights of any third party; or
- Is defamatory, harassing, threatening, or constitutes hate speech against any individual or group.
3. Prohibited Activities
You may not use the Services to engage in, support, or facilitate any of the following:
- Operating command-and-control infrastructure for botnets, malware distribution networks, or any other malicious automated systems;
- Conducting automated network scanning, port scanning, or vulnerability probing of external hosts or networks without explicit authorisation from the target system owner;
- Cryptocurrency mining, blockchain computation, or any other computationally intensive background processing not incidental to legitimate web hosting activity;
- Operating public proxy services, VPN exit nodes, open relay mail servers, or anonymisation services accessible to third parties;
- Operating IRC bots, automated relay services, or high-frequency automated polling systems;
- Reselling, subletting, or otherwise distributing service resources or access to unaffiliated third parties outside the scope expressly permitted by your service plan; or
- Any activity that intentionally or materially degrades the performance, availability, or security of Sivda's shared infrastructure or other clients' services.
4. Email and Messaging
The use of any Service to originate, relay, or facilitate the delivery of unsolicited bulk commercial electronic messages (spam) is strictly prohibited. Where a service plan includes outbound email functionality, the following rules apply without exception:
- All marketing, promotional, or list-based email campaigns must comply with the UK Privacy and Electronic Communications Regulations 2003 (PECR) and must employ verified double opt-in subscription procedures;
- The use of purchased, rented, scraped, harvested, or otherwise unverified mailing lists is prohibited;
- Outbound email sending rates are subject to the hard limits specified in your plan; any attempt to circumvent or buffer against those limits constitutes a breach of this policy; and
- Any activity that causes Sivda's outbound mail infrastructure to be listed on any public email reputation blacklist — including but not limited to Spamhaus, Barracuda, or SORBS — constitutes a material breach of this AUP and may result in immediate account termination without notice or refund.
5. Resource Usage
You are responsible for ensuring that your use of the Services does not consume server resources — including CPU, RAM, disk I/O, and network bandwidth — at levels disproportionate to your service allocation or that materially degrade the shared hosting environment for other clients. Sivda reserves the right, acting reasonably, to:
- Throttle or temporarily restrict resources on any account whose usage exceeds allocated thresholds;
- Immediately suspend, without prior notice, any service whose resource consumption poses a risk to infrastructure stability or to other clients; and
- Require the Client to upgrade to an appropriate service tier before the suspended service is restored.
6. Copyright and Intellectual Property
Upon receipt of a valid and legally compliant copyright or intellectual property infringement notice, Sivda will notify the relevant Client and take appropriate action in accordance with applicable law, which may include removal of or disabling access to the allegedly infringing content. Sivda reserves the right to terminate services of Clients who are the subject of repeated or credible intellectual property complaints, or whose hosted content generates sustained external legal or regulatory pressure against Sivda's network.
7. Law Enforcement Cooperation
Sivda will cooperate fully with law enforcement agencies, courts, and regulatory bodies in the United Kingdom and, to the extent required by applicable law, in other jurisdictions. Where lawful disclosure of information is required pursuant to a valid legal process, Sivda will provide the relevant information in compliance with that process.
8. Enforcement
Sivda reserves the right to take any action it deems appropriate and proportionate to enforce this AUP, including: (a) issuing a formal warning to the Client; (b) removing or disabling access to content in breach of this policy; (c) suspending or terminating the relevant service without notice or refund; and (d) disclosing information to law enforcement or regulatory authorities where required by law or where Sivda, acting reasonably, considers it necessary to prevent harm to third parties or to protect the integrity of its network.
9. Reporting Abuse
